Terms of service

What a school is agreeing to, and what we are committing to in return.

Draft, pending legal review. This document describes how Kundi is built and how it is intended to operate. It has not been reviewed by a lawyer or filed with the Nigeria Data Protection Commission, so do not rely on it as a legal instrument yet. Questions in the meantime: hello@kundihq.com.

1. Who the agreement is with

Kundi is operated by DaboLinux Technologies (BN3238495), Kano, Nigeria. These terms are between us and the school that holds the account. Teachers, bursars, guardians and pupils use Kundi through their school's account, not under a separate agreement with us.

2. The account

A school is responsible for who it gives access to and for keeping that list current. Tell us promptly if an account is compromised. We will not give anyone access to a school's data on the say-so of an individual staff member without the school's authorisation.

3. Plans, limits and payment

Plans are priced by active student count, not per user. A school can add as many staff and guardian accounts as it likes. Current prices are on the pricing section and are indicative until confirmed in writing for your school. They exclude payment processor charges.

Paid plans are billed annually by default. Termly payment is available, because schools budget by session. Prices can change, and we give at least one full term's notice before a change affects an existing school.

When a school passes its student limit, we contact the school. We do not delete pupils to force a downgrade.

4. What happens when payment stops

This matters more than most clauses here, so it is written plainly.

SuspendedWrites stop. Reading and export continue. Nothing is deleted.
CancelledExport stays available. We delete the school's data on request, or after the retention period agreed in the data processing agreement.
Module removedThat module's data stays readable and exportable. A school that drops accounting keeps its ledger, because it is legally obliged to.

Export is never gated. Not on the free plan, not while suspended, not after cancellation.

5. Your data

The school owns its data. We hold it as a processor, on the school's instruction, under a data processing agreement. The privacy notice sets out what that means in practice. We do not sell it, use it for another school, or train models on it.

6. What we commit to

  • To keep each school's data separated at the database level
  • To keep export working, on every plan and in every account state
  • To give notice before a price change or a new sub-processor
  • To tell affected schools about a data breach within 72 hours
  • To include setup, migration and staff training on paid plans

We do not yet publish an uptime guarantee, because we would rather not promise a number we have not measured over a full session. Ask us where we are.

7. Acceptable use

Do not use Kundi to store data unrelated to running your school, to send messages guardians have not agreed to receive, to attempt access to another school's account, or to break Nigerian law. We can suspend an account that does, and we will tell you why.

8. Ending it

A school can leave at any time. Tell us, export your data, and we will delete it on request. We would ask, but not require, that you switch between terms rather than during one. If we ever have to end the service, we will give at least one full session's notice and keep export working throughout.

9. Liability

Kundi is provided as it is. We are liable for our own failures to the extent Nigerian law requires, and our total liability in any twelve-month period is limited to the fees paid by that school in the same period. Nothing here limits liability that cannot be limited by law, including under the Nigeria Data Protection Act 2023.

A school remains responsible for the accuracy of what it records, including results and financial entries. Kundi keeps a permanent, reversible record; corrections are posted as reversals rather than quiet edits, so mistakes stay visible.

10. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Kano State have jurisdiction.

11. Changes

We will tell schools before these terms change materially, and the date at the top always reflects the current version.
